A defendant shall be punished by imprisonment for not less than eight months.

피고인은 2015. 10. 8. 22:00경 포천시 C 노상에서, 집에 도둑이 들었다는 피고인의 112 허위신고를 받고 출동한 D파출소 소속 경위인 피해자 E(49세)으로부터 피해진술서를 건네받자 ‘상업(절도, 강간, 강도)’이라고 장난으로 작성하고 “경찰새끼들은 못믿는다”며 욕설을 하는 등 행패를 부리며, 위 E의 멱살을 잡아 흔들고 넥타이를 잡아당겨 목을 조르고, 피고인을 진정시킨 후 현장을 떠나려는 위 E에게 “이 씹새끼들아”라고 욕설을 하면서 멱살과 넥타이를 잡고 흔들고 발로 허벅지를 1회 걷어찼다.

계속하여 피고인은 위 E을 지원하기 위해 출동한 F지구대 순경 G에게 “순경 일루와봐 씨발년아 미친년”이라고 욕설을 하며 G의 다리에 자갈을 던지고, 복부를 발로 1회 걷어찼다.
