1. Defendant B, C, D, E, F, H, and I are with respect to each of the said money stated in the attached Table “amount of damages” and each of the said money to the Plaintiff.

1. Facts of recognition;

A. Defendant B, C, D, E, F, H, and I heard the speech that they would grant a loan from an unqualified person on November through December 12, 2013, and they transferred a passbook, check card, cash card, password, etc. opened in their own name to an unqualified person.

B. On December 9, 2013, the Plaintiff sent money as indicated in the “amount of account transfer” in the attached Table from December 9, 2013 to December 12, 2013, after hearing by telephone the words “J is the person in charge of loan from the present loan, and would be the person in charge of loan from another loan business.” The Plaintiff deposited money with the account designated by the person in charge of the name payment from December 9, 2013 to December 12, 2013.

C. From December 9, 2013 to December 12, 2013, a person whose name was defective entered in the account in the name of the Defendants using a passbook, check card, or cash card that was transferred by the Defendants as shown in the attached Table No. 1210, and entered the money from the account in the name of the Defendants by using the passbook, check card, or cash card.

2. Determination

A. In a situation where the occurrence of the liability for damages caused by the Defendant G’s claim against the remaining Defendants, other than Defendant G, is widely known socially, the said Defendants may sufficiently anticipate that the said Defendants may be used for the crime of singing, such as the instant case, in a case where the account number, cash card, physical card, password, etc. of the passbook is transferred.

Therefore, even if the above defendants did not actively participate in the crime of this case by a person without a name, they easily committed the crime by transferring the account number, check card, cash card, and password to the person without a name.
