1. The Defendant’s KRW 59,649,020 as well as the Plaintiff’s annual rate of 5% from November 20, 2018 to September 29, 2020, and the following.

1. Basic facts

A. On April 3, 2017, C Co., Ltd. entered into a subcontract with the Plaintiff with the content that it would subcontract the instant subcontracted construction work to the Plaintiff by setting the gas charging pumps system (including value-added tax 34,950,000,000 (including value-added tax) for the construction period from April 3, 2017 to June 30, 2017 (hereinafter “the instant subcontract construction”).

In addition, the Plaintiff re-subcontracted the construction work for gas pumps system heating and cooling facilities (hereinafter “instant construction work”) from April 30, 2017 to June 30, 2017, with the Defendant managing the business entity called “F” on April 3, 2017, the Plaintiff re-subcontracted the construction work period of KRW 151,80,000 (including value-added tax; hereinafter “the instant construction work cost”) to the Plaintiff as the construction cost. As to the scope of the instant construction work, the Plaintiff excluded the scope of the instant subcontracted work from ① concrete sprink and fences for outdoor use, and the construction contract (hereinafter “the instant construction contract”).

B. The Plaintiff paid the Defendant the instant construction cost, ① KRW 35,00,000 on April 19, 2017, ② KRW 117,50,000 on the aggregate of KRW 82,50,000 on June 1, 2017 (i.e., KRW 35,000,0000, KRW 82,500,000, and hereinafter “prepaid construction cost”).

C. The Defendant performed the instant construction project from April 30, 2017 to June 2017, but failed to complete the instant construction project as of June 30, 2017, which was the completion date of the instant construction contract.

(A) The part of the instant construction work executed by the Defendant by June 30, 2017 is referred to as “the part of the instant construction work.”
