A person shall be punished by imprisonment with prison labor for not more than two months and by imprisonment for not more than one year and six months for the remaining crimes.
Reasons
Punishment of the crime
[criminal history] On July 16, 2014, the Defendant was sentenced to one year and six months of imprisonment with prison labor for an injury, etc. at the port branch of the Daegu District Court, and completed the execution of the sentence on December 5, 2015. On June 22, 2017, the same court was sentenced to 8 months of imprisonment with prison labor and 100,000 won of fine due to an assault, etc. and completed the execution of the sentence on September 29, 2017.
[Criminal facts]
1. Obstruction of business;
A. On April 2016, the Defendant committed a crime against the Victim C on April 1, 2016: (a) from around 05:00 to around 05:25 on April 1, 2016, the victim of the crime committed against the victim: (a) in the E shop where the victim was an employee, who was requested from the victim to make an account from the victim by taking out the fluor inside the fluor in the air condition, and leaving the fluor in the air condition; and (b) in order to demand the victim to take out the fluor in the air condition after leaving the fluor in the air condition, the victim was able to take the fluor who was worn by the victim from the floor to the fluor in the display stand, thereby hindering the victim’s business operation by force by force.
B. On December 19, 2017, the Defendant committed the crime against Victim F with the victim on December 19, 2017, at the H store located in the north-gu G in the port from around 18:00 on December 19, 2017 to 18:40 on December 19, 2017.
