A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

around 11:30 on April 17, 2012, the Defendant stated to the effect that “Ulsan-gun G and H site (hereinafter “the instant site”) was planned to sell 50 houses to the victim F, Inc. in Ulsan-gu G and Ulsan-gu G, and H site (hereinafter “the instant site”) by selling 50 houses to the victim F, and that the Defendant would supply the sales deposit amount of KRW 60 million to KRW 30 million, the highest price of KRW 30 million, compared to other persons, at the face of the week.”

However, at the time, the construction work of the instant site was suspended due to the payment of the construction cost, and the Defendant did not have any intent or ability to sell the leased house to the victim even if he received money from the victim as sales deposit because the said construction work itself was not the owner of the said electric source housing construction, but has no asset with bad credit standing.

After all, the Defendant, as above, was accused of the victim and received 60 million won from the victim, i.e., the account in the name of one bank under the name of the victim as the down payment in lots.

Around July 25, 2012, the Defendant made a false statement to the victim L, “Agsan-gun, U.S. H. H. H. H. H. 18,939 square meters per square meter,” stating that “Agsan-gun, U.S. H. H. 18,939 square meters per square meter, who wishes to sell a site of 495.86 square meters per square meter to KRW 70,000 or KRW 80,000 per square meter, shall be sold in lots at KRW 30,00 per square meter.”

However, in fact, the construction work of the above entire site was suspended on or before February 2012, and there was a fact that around June 8, 2012, a written statement of business rights and waiver of construction regarding the construction work of the entire site for the above forest land was prepared, and there was no assets with bad credit standing, and there was no intention or ability to sell the above forest land to the victim after creating the housing site for the above forest land.

As above, the Defendant deceivings the victim, that is, from the victim, the purchase price of the said housing site is KRW 45 million and down payment is KRW 10 million.
