1. The defendant receives 65,00,000 won from the plaintiff (Appointed Party C), the Appointed Party C, the Selected Party D, and the Appointed E.
Reasons
1. Facts of recognition;
A. 1) On October 20, 2005, F entered into a lease agreement with the Defendant on approximately 51 square meters in the first floor and about 15 square meters in the underground space of the building listed in the separate sheet with respect to KRW 65 million in the lease deposit, KRW 3 million in the rent, and the period from November 1, 2005 to October 30, 2007 during which the above lease was renewed. 2) On October 1, 2009, F entered into a lease agreement with the Defendant with respect to the above real estate with regard to KRW 3.2 million in the rent, and the period from November 1, 2009 to October 30, 201.
B. On May 10, 2010, with respect to each of the 1/4 shares of the buildings listed in the separate sheet, the registration of ownership transfer was completed on May 10, 2010 under the name of the Plaintiff (Appointed Party; hereinafter “Plaintiff”) and the Selection C, Selection D, and Selection E (hereinafter “Appointed”) (hereinafter “Appointed”).
C. On July 1, 2011, the Plaintiff entered into a lease agreement with the Defendant, with respect to all and underground parts of the first floor of the building listed in the separate sheet, with respect to the lease deposit amounting to KRW 65 million, KRW 2,909,000 per month, and the period of October 30, 2011, and the said lease agreement was renewed later.
On October 7, 2015, the Plaintiff entered into a lease agreement with the Defendant on approximately KRW 160.02 square meters on the part (a) inside the ship (hereinafter “instant real estate”) connected in sequence with the indication 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 10 and 1 of the attached drawings among the first floor of the building listed in the attached list among the first floor of the building listed in the attached list (hereinafter “the instant real estate”) from the designated parties, with respect to the lease deposit of KRW 65 million, the rent of KRW 380,000,000 from October 31, 2015 to October 30, 2016, from October 31, 2016 to October 30, 2017 (hereinafter “the lease agreement”).
