The defendant's KRW 113,163,177 to the plaintiff as well as 5% per annum from November 22, 2018 to October 23, 2020.

Basic Facts

A. On September 29, 2017, the Plaintiff entered into a contract for the instant construction contract and for the Plaintiff’s payment of the price, setting the construction cost of KRW 370,000,00 (excluding value-added tax) and the construction period of KRW 90 from September 29, 2017 to September 10, 2017 to the first underground floor (hereinafter “instant commercial building”) in Sung-nam-si, Sungnam-si, for the purpose of operating the bowling site (hereinafter “instant construction contract”). The Plaintiff paid KRW 370,80,000 to the Defendant from September 29, 2017 to April 10, 2018.

B. From November 9, 2017 to January 10, 2018, the Defendant: (a) imported 172,743,693 won in total; (b) delivered the instant commercial building on January 10, 2018; (c) suspended construction works on May 2018; and (d) discontinued construction works on the instant commercial building.

C. On May 29, 2018, the Plaintiff entered into a contract with D to carry out 104,00,000 won of the construction cost (excluding value-added tax) and the period from May 29, 2018 to June 22, 2018 with respect to the supply of bowling parts and installation works, which are not installed by the Defendant. ② On June 15, 2018, the Plaintiff entered into a contract to carry out 102,50,000 won in total (including value-added tax) with E, the construction period from June 1, 2018 to June 20, 2018; ③ to purchase 208,000 won in total with G air conditioners and 208,50 won in total; and ④ to purchase 208,000 won in total with G air conditioners and 13,404,1681,608,208.
