A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 2016, the Defendant: (a) accepted a proposal from a person without the name of “C chief” on the Internet job-seeking site to deliver the goods, and then sent the goods again; and (b) accepted a proposal to offer KRW 1,500,000 per month on the part of a week; (c) in accordance with the direction of the person without the name, the Defendant sent the cash sent by using the selective or Kwikset to a person without the name, or deposited it into the Korean bank D account managed by the Defendant, and then transferred the cash to another person or re-exported, Kwikset service costs, and the Defendant’s monthly wage, etc.
Although the Defendant first agreed to deliver electronic equipment under the employment of the above person in the name of the Defendant, the Defendant received cash in the paper stuff and subsequently sent it again. As above, it was well aware that it was an abnormal method to receive the cash from Kwikset Service or on the part of the Defendant’s monthly pay in the same way and then deliver it to the person in the name imprisony in the same way. The Defendant’s monthly pay was much higher than the Defendant’s daily pay compared to the Defendant’s daily pay, and the Defendant’s personal injury was much higher than the Defendant’s daily pay.
