A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

[2019 Highest 7865] The Defendant is formally registered as a motor vehicle dealer in the “C” of the Association B, but in fact, is a person who engages in a middle and highest sales business independent of the said commercial company.

Any person who intends to run a motor vehicle management business, such as motor vehicle sale, shall register with the head of a Si/Gun/Gu.

Nevertheless, the defendant does not register with the competent authorities;

On May 22, 2019, in the Michuhol-gu Incheon Metropolitan City D, F made a false speech as if he could purchase the ENS car at KRW 2.5 million, and notified F that the said NNS car is at issue with an electronic control system, and led F to purchase another vehicle, thereby selling and buying the vehicle or arranging the purchase of the vehicle;

2. On August 24, 2019, around Incheon Seo-gu, engaged in business activities for arranging the purchase and sale of vehicles, such as displaying H an Inibus vehicle, and displaying J-learning vehicle.

Accordingly, the defendant carried on the automobile transaction business without being registered with the competent authorities.

[2019 Highest 8192] The Defendant is a middle-end dealer, and the Defendant entered into a contract with a customer at a price significantly lower than the market price by guiding the customer to enter into the contract, stating that there is a defect in the above objects, and showing other objects while making a false statement, and at the same time, in order to acquire the difference by informing the customer of the amount lower than the market price as the purchase price and concluding the contract.

On August 24, 2019, the Defendant entered into a sales contract with the victim H, who was found as a customer by reporting the IBBC photograph, which is an object of moscoob, and showing the above U.S. vehicle to the victim H, who was found as a customer, and entered into a sales contract with the Defendant stating that “3 million won is to be paid,” and the vehicle “A” occurred.
