A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, via B, made a false statement on the part of the victim C, stating that “The sales of cellphone 7,00,000,000 won,” which the victim: (a) contacted the victim; and (b) promised to purchase the victim’s cell phone at KRW 2,30,000,000; and (c) made a false statement on October 31, 2018, that “The victim would account transfer the victim’s cell phone to KRW 2,30,000,000,000

However, the defendant did not have the intent or ability to remit the amount of mobile phone to the victim even if he/she receives the mobile phone from the victim, such as using the money possessed without a certain amount of income for obligations and living expenses of others.

The Defendant, by deceiving the victim as above, received a 7 mobile phone device from the market-merchants at the seat, namely, a victim who is under his control, and acquired it by deception.

2. Violation of the Punishment of Violences, etc. Act;

A.
