Defendant shall be punished by a fine not exceeding eight million won.

Where the defendant fails to pay the above fine, one million won shall be the one day.

Punishment of the crime

On October 13, 2006, the Defendant was issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act (drinking driving), and a fine of KRW 2.5 million for a crime of violating the Road Traffic Act at the Seoul Western District Court on September 26, 2008, respectively.

On March 13, 2018, the Defendant driven B EX car at approximately 100 meters from the entrance of the second apartment unit of Eunpyeong-gu Seoul, 0.204% alcohol concentration among blood transfusion, to about 38, 100 meters from the 2nd 2nd 207 East-ro, the Defendant driven B EX car at around 100 meters from the 2nd 2nd 207nd east.

As a result, the Defendant, who violated the prohibition on drinking at least twice, was driven under the influence of alcohol again.

Relevant legal provisions concerning criminal facts, Articles 148-2(1)1 and 44(1) of the Road Traffic Act, the choice of a fine (the history of driving under the judgment below was relatively old, and there was no criminal history other than the above previous conviction, the distance of driving under the influence of alcohol was relatively short, the crackdown on drinking while returning home to neighboring residence due to the substitute driving, and all other circumstances, including the Defendant’s age, sex, environment, etc.);

1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;

1. Article 334 (1) of the Criminal Procedure Act concerning the order of provisional payment;
