The defendant's appeal is dismissed.

1. The summary of the grounds for appeal (misunderstanding of facts) did not constitute assaulting a victim as stated in the facts charged in this case (the Defendant stated his defense counsel’s written opinion on November 16, 2018, which contains the purpose of sentencing unfair on the grounds of appeal, on November 16, 2018, which included the second trial date, but this cannot be a legitimate ground for appeal since it was asserted after the lapse of the period for appeal, and there is no ground for ex officio review). 2. The Defendant asserted to the same effect in the lower court, and the lower court rejected the Defendant’s assertion in determining that he was guilty of the facts charged in this case on the grounds as stated in its reasoning. In light of the evidence duly adopted and examined by the lower court and the lower court, the above judgment of the lower court is justified, and contrary to the reasoning of the lower court, it erred by misapprehending the facts and adversely affecting the conclusion of the judgment.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
