A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is operating D in Changwon-si Seoul Special Metropolitan City C 244.

1. On July 2013, 2013, the Defendant sent a notice to the effect that “The Defendant would interfere with the qualification training (2.80,000 won, total of 60,000 won of qualification training expenses, and 3.440,000 won of teaching materials) conducted by the Busan Red Cross Center located in Busan-dong, Busan-dong, Busan-do, to many persons, including victims E, who received education in D (hereinafter referred to as “health education instructor”), on July 27, 2013.”

However, in fact, the qualifications for health traditional food education instructors were registered as non-official civil qualifications in the Korea Vocational Skills Development Institute, and there was no fact that they were registered as official qualifications.

On July 27, 2013, the Defendant, by deceiving the victim as above, received 340,000 won from the victim under the pretext of the qualifications for health and food education instructors, training expenses, and teaching materials expenses for health and food education instructors, and acquired 1,584,00 won in total from 47 victims as stated in the attached list of crimes on the same day as in the attached list of crimes.

2. On July 2013, the Defendant attempted to commit fraud: (a) sent a written notice to the effect that “The Defendant would interfere with the qualification training (2.80,000 won, total of 60,000 won of qualification training expenses, and 3.40,000 won of teaching materials) conducted by the Busan Red Cross Center located in Busan-dong, Busan-dong, Busan-do, to the victim F, who received education in D, at the post office located in the Jinhae-si, Changwon-si, Changwon-si, Busan-si, and received education in D, (b).” (c)

However, the qualifications of health traditional food education instructors have been registered as civil qualifications in the Korea Vocational Skills Development Institute, and they have been accredited.
