A defendant shall be punished by imprisonment for not less than eight months.

The defendant pays 10,000,000 won to the applicant for compensation by deceit.

3.2

Punishment of the crime

On October 16, 2017, the Defendant sent 5 million won to E account by the head of the personnel team who is in charge of the management of its members to E as a regular employee of the golf course through C through contact with the victim B on October 16, 2017. However, the Defendant made a false statement that the victim would be employed as a regular employee of the golf course when transferring 5 million won to E account by the head of the personnel team.

However, the Defendant was merely engaged in the short-term repair work at the above golf course, and was not a director of the golf course. The Defendant did not have the intent or ability to employ the victims' children as regular employees of the golf course. At the time, the Defendant was able to use the victim's personal debt amounting to KRW 60 million when he was transferred with the said money.

Nevertheless, the Defendant, as seen above, received KRW 5 million from the victim to the Agricultural Cooperative (F) account under the name of the Defendant used for the purpose of job placement assistance on October 20, 2017, and received KRW 10 million in total over three times from that time to January 15, 2018 by the following method, as shown in the attached list of crimes, from the victim.

The Defendant came to know about the victim G through the “H” in the 2019 Highest 1889.

On December 23, 2018, the Defendant made a false statement to the effect that “The Defendant works for a financial team of a golf course located in the Masan Military unit, which is located in the Masan Military unit, is going to open again. However, the defendant does not have worked for the financial team of a golf course in the U.S. military department, and even if he receives money from the victim as investment money without the intention to deliver the case.
