1. The Defendants shall jointly and severally pay to the Plaintiff KRW 160,000,000 and the interest rate thereon from April 23, 2013 to the date of full payment.
Reasons
1. Basic facts
A. Defendant B Co., Ltd. (hereinafter “B”) is a company mainly engaged in construction and civil engineering, and Defendant C Co., Ltd (hereinafter “C”) is a company with the main purpose of real estate consulting business.
B. As the executor of the Construction of Complex Facilities in Ulsan-gun, Ulsan-gun (hereinafter “instant Construction”), Defendant C entered into a contract for construction works with a national comprehensive construction company (hereinafter “Nad comprehensive construction”). Of the foregoing construction works, E Co., Ltd (hereinafter “E”) received subcontracting from a national comprehensive construction company, and continued construction works due to the circumstances of national comprehensive construction.
C. Accordingly, on April 9, 2012, G, which was the actual owner of Defendant C’s inspection, drafted a standard contract for construction works with the purport that Defendant B, who is an employee of Defendant B, will resume construction works in the country’s comprehensive construction (hereinafter “the contract for construction works”). On the same day, the contract for the construction works was drafted as of April 9, 2012, and the instant payment note was prepared as of May 17, 2012. On the bottom of the payment note, the lower court stated “B(s) representative director I, and the guarantor(s)” as the “J representative director of each company” and affixed the seals of each company.
The construction site: Ulsan Metropolitan City, Ulsan Metropolitan City D payment: The amount of daily gold 160,000,000,000 Won (Won 160,000,000) is to be paid to E by applying for bank loans (not less than 45 days required) with the construction funds for city events with the amount of KRW 10,000,000,000,000,000,000,000,000.
C. Meanwhile, the Plaintiff owned claims regarding E, including material costs and wages equivalent to KRW 160,000,000, but E on March 26, 2013.
