Reasons
Punishment of the crime
D (Disposition of suspending prosecution at the former District Prosecutors' Office on November 28, 2013) is the representative director of E Co., Ltd. (hereinafter referred to as "E"), F is the person who serves as the president of E in the position of E, G is the person who engages in the regular business from the F below, and the defendant is the person who has entered into a contract with E for the sale of real estate.
In fact, the Defendant concluded a commercial building parcelling-out contract with H reconstruction association (hereinafter referred to as the “renovation association”) on the rebuilding price of the said rebuilding association, and there is no right to sell the commercial building, and even if he concluded the commercial building parcelling-out contract with the several buyers, despite the lack of intent and ability to sell the commercial building of the said reconstruction association, the Defendant concluded a commercial building parcelling-out contract with the victim I (36 years old) recruited by the Defendant as if he had the right to sell the commercial building of the said reconstruction association, and conspired with the said D, F, and G to receive the sales price of the commercial building by concluding the commercial building parcelling-out
D around December 2006, through the defendant who entered into a contract with F and G for the commercial building parcelling-out through the defendant who entered into the contract with E, and ordered F and G to receive the cost of commercial building parcelling-out of KRW 200 million, and F and G concluded a commercial building parcelling-out contract with the defendant known of D's instructions and as soon as possible to collect part of the cost of commercial building parcelling-out.
On January 10, 2007, the Defendant: “E has the right to sell the commercial buildings of H reconstruction association; “E has the right to sell the commercial buildings to the party; at first, the estimated sale price of the commercial buildings is between KRW 120,000 and KRW 30,000,000,000 per square year; and at the end, half of the expected sale price of the commercial buildings can be seen as the profits from the commercial building; “F may enter into a contract with the victim and KRW 390,000,000,000,000,000,000.
