A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특수폭행 피고인은 2019. 10. 3. 19:25경 충남 계룡시 B 아파트 C동 주차장 앞에서 특별한 이유 없이 술에 취해 이웃주민으로 일면식이 없는 피해자 D(여, 27세)의 눈에 위험한 물건인 레이저 포인터 빔을 지속적으로 쏘며 “씨발년아 뭘 봐, 안 꺼져, 너 이리와 미친년아”라는 등 욕설을 하였다.

Accordingly, the defendant carried dangerous objects and assaulted the victim.

2. 공무집행방해 피고인은 2019. 10. 3. 19:29경 충남 계룡시 B 아파트 C동 주차장 앞에서 112 신고를 받고 출동한 충남 논산경찰서 E지구대 소속 경찰공무원인 경위 F, 경위 G로부터 제지를 받자 술에 취해 화가 나 “무슨 일로 나왔냐, 짭새 새끼야, 사복 입고 집에 가다가 나한테 걸리지 마라, 다리 분질러 버린다, 내가 힘이 세다”라고 소리치며 위협하였고, 계속해서 휴대전화에 저장된 피고인이 일본도를 들고 있는 사진을 보여주며 “이게 뭔지 아냐, 이걸로 쑤셔버린다”라는 취지로 말하며 주먹으로 때릴 것처럼 행동을 하는 방법으로 위협하였다.

이후에도 피고인은 주머니에서 차량 스마트키를 빼 금속키를 분리한 후 이를 주먹에 쥔 채 경찰공무원인 경위 F의 얼굴을 찌를 듯이 하였고, 바닥에 차량키와 레이저 포인터를 집어 던지는 등의 방법으로 위협하였다.

As a result, the Defendant interfered with police officers' legitimate execution of duties concerning 112 reporting affairs and prevention, suppression, investigation, etc. of crimes.
