1. The Defendant shall pay to the Plaintiff KRW 35,876,824 and the interest rate of KRW 20% per annum from February 5, 2019 to the day of complete payment.
Reasons
1. Basic facts
A. The Plaintiff, from January 1, 2006, joined the Defendant and retired from office around January 21, 2019.
B. After retirement, the Plaintiff asserted that there was an unpaid annual allowance and retirement allowance, but failed to comply with this, the Defendant’s representative director C received a written overdue payment from the following mountainous district offices of the Gwangju Regional Employment and Labor Agency. In the above case, the sum of the Plaintiff’s unpaid annual paid leave allowance, which was confirmed as a result of the investigation by the labor inspector, is KRW 4,886,836, and retirement allowance is KRW 30,989,988.
C. On April 29, 2019, C: “Plaintiff’s unpaid annual paid leave allowances of 751,821 won, annual paid leave allowances of 751,821 won, annual paid leave allowances of 1,288,836 won, annual paid leave allowances of 1,127,731 won, annual paid leave allowances of 1,71 won, annual paid leave allowances of 1,718,48 won, annual paid leave allowances of 4,86,836 won, and annual paid leave allowances of 30,98,988 won and annual paid leave of 14 days from the date of the occurrence of the cause for payment on September 1, 2017; Defendant was convicted of the charges of violating the Labor Standards Act, and Defendant was convicted of the charges of violating the Labor Standards Act, and Defendant’s entire suspended execution of 2019.3 days from the date of the occurrence of the cause for payment.”

2. The assertion and judgment
A. According to the above facts finding as to the cause of claim, barring any special circumstance, the Defendant is obligated to pay to the Plaintiff annual paid leave allowance and retirement allowance totaling 35,876,824 won (=4,886,836 won, 30,989,9888 won) and damages for delay calculated at the rate of 20% per annum from February 5, 2019 to the date of full payment, 14 days following the date of retirement of the Plaintiff.
