1. The defendant shall be the plaintiff.

Reasons
1. Basic facts
A. On February 25, 2016, the Defendant leased and occupied part of 184 square meters of 184 square meters of 1st floor and 24 square meters of 184 square meters of 1st floor and 184 square meters of 1st floor, such as the land No. 2 in the attached Table 1 List No. 2 from C (the land divided from the Seoul Seongbuk-gu D river site, January 24, 2014; the “instant land No. 2”), etc., and filed a claim for the delivery of a building against the Defendant by the E Housing Redevelopment and Improvement Project Association as Seoul Northern District Court 2015No12306, the Defendant was subject to compulsory execution based on the said final judgment on June 9, 2017.
B. On February 27, 2017, the Plaintiff entered into an exchange contract on the land No. 1 and No. 2 as indicated in the Appendix No. 1 List (hereinafter “instant land”) and the instant land (hereinafter “each of the instant land”) and concluded an exchange contract on February 28, 2017. The Seoul Northern District Court’s Seoul Northern District Court’s 37/95 shares as to the instant land No. 1 as the receipt No. 15720 on February 28, 2017, and 422/626 shares as to the instant land No. 2.
C. The Plaintiff installed a steel pent in the vicinity of each of the instant land, etc. in order to perform the construction work for the extension work for the 1st and the 5th above ground surface on each of the instant land, etc., and the Defendant, after being subject to compulsory execution as above, removed the steel pents installed by the Plaintiff, entered the construction site and entered the construction site, installed each tent as described in the Disposition 1’s paragraph (a) on each of the instant land, and loaded goods, such as small waves, etc. on the part as described in Disposition 1’b of this case.
On March 27, 2019, the Plaintiff asserted that the Defendant occupied each of the instant land owned by the Plaintiff without any title as Seoul Northern District Court 2019Kahap20108.
