1. The Defendant’s KRW 39,400,170 as well as the Plaintiff’s annual rate from November 29, 2014 to October 28, 2015.

1. Formation of liability for damages and occurrence of the right of indemnity;

A. The facts of recognition are as follows: (a) around 13:40 on November 24, 201, the defendant driving a B-car on around 13:40, and shocked E while driving the C-W car on the road in front of the C-C-W D set of Gwangju Dong-gu, Gwangju (hereinafter “instant accident”); (b) the said accident inflicted bodily injury on E, i.e., light-f., light-free blood, etc.; and (c) the present status of recognition disability and walking disability; (d) the defendant was only liable for liability insurance for the said car; (c) the plaintiff was an insurance company that entered into the injury insurance contract with F-F; and (d) the plaintiff was an insurance company that entered into the accident insurance contract with F-free motor vehicle; and (e) as one of the insured exceeds the liability insurance amount, the plaintiff paid KRW 65,66,950 with the insurance amount by August 31, 2014; or (e) the purport of the entire pleadings and arguments is acknowledged as follows:

According to the facts of the above recognition, the defendant is liable to compensate the damages suffered by E due to the instant accident as a direct tortfeasor of the instant accident, and the plaintiff is liable to compensate for the damages incurred by E as the insurer by paying the insurance money equivalent to the medical expenses to E, and thus, the defendant is liable to compensate the plaintiff for the medical expenses paid by E within the scope of the amount of damages.

According to each description of Gap evidence Nos. 2 and Eul evidence Nos. 5-1 to 10 of the scope of the exercise of damages and the right to indemnity, it is recognized that the current state of E appeal for recognition and pedestrian disability, and that he/she has a mental disorder; that he/she has appraised that the present symptoms of E are highly likely to be changed due to brain damage in the past, considering that the symptoms of E are medical history; that the neighbors of E have symptoms of dementia in the past, and that he/she is stated that he/she cannot cross-rhe/shes the horses or easily identify people.
