Reasons
Punishment of the crime
1. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, etc. (Distribution of obscenity) shall distribute information with an obscene content distributed, sold, rented, or displayed openly in the form of code, text, sound, image, or picture through an information and communications network;
Nevertheless, the Defendant, along with B, posted a large number of obscene materials files on the Internet file sharing site, such as D, at around November 2017 at the residence of Gangseo-gu Seoul Metropolitan Government, and proposed that he would have another user receive profits from exchanging points at a certain rate when other users download the files. The Defendant posted obscene materials on the file sharing site opened in his father F name and B, and managed and distributes profits by using the name of the Defendant (G bank account number H) and the Defendant’s female-friendly I (G bank account-Account Number J) account. The Defendant borrowed the name of the file sharing site and transferred profits from his account (G bank account number H) to the said I account, and if it was discovered in the course of committing a crime, he was investigated by the Defendant instead of the Defendant.
Since July 2018, the Defendant connected the Internet file sharing websiteO in the name of the Defendant’s father at the Defendant’s residence in the Nam-gu Busan Metropolitan City M No. N., and then up to August 31, 2018, the Defendant, via the former Internet, up to 10,00 won, up to the title “P” using the automatic file file business program “Puplod” purchased through the user fee of 80,000 won each month, posted obscene materials with the contents of exposing the chest, sex, and antipath, etc. of R (Ga name) from November 13, 2017 to August 31, 2018, as shown in the list of crimes in the attached Form.
