Basic Facts

On July 9, 1955, the Plaintiff’s Plaintiff’s attached 296 square meters for DJ 296, completed the registration of ownership transfer on the ground of sale and purchase on January 5, 1955, and on April 21, 1992, 235 square meters out of the above land were divided into F land; on July 30, 200, 7 square meters out of the above land were divided into G land; on January 23, 1998, E died on January 23, 1998, the Plaintiff completed the registration of ownership transfer on the ground of inheritance by consultation and division on the above land; on August 23, 201, the above land was combined with H large 20 square meters and D large 756 square meters (hereinafter referred to as “the adjoining land”).

On December 8, 1978, the Defendant’s attached I died on April 10, 1993 after completing the registration of ownership preservation in accordance with the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094) with respect to the land of this case (hereinafter “instant land”). The Defendant completed the registration of ownership transfer by agreement division on January 31, 2017.

Around March 3, 1935, there is a 66.1 square meter and 19.83 square meter and 16.53 square meter and 16.53 square meter and 16.53 square meter and 19.2 square meter and 1970 square meter in the adjacent land of the instant case, which was completed around March 3, 1935, on the land adjacent to the instant case. In the J-Myeon self-inspection conducted around June 2, 1986, it was confirmed that E is the owner of the said building.

Since before 1955, there has been a stone fence on the line that connects each point of the attached Form No. 7, 8, 9, 10, 16, 15, 14, 13, 12, 4, 5, 6, and 7 (hereinafter “the boundary of this case”) among the adjacent land and the ground buildings of this case.
