The defendant is not guilty. The summary of the judgment against the defendant shall be published.

1. The Defendant, who is a residential area, is a person engaging in the manufacturing business of industrial machinery parts under the trade name “D” in the Si interesting City Co., Ltd.

A person who intends to conduct a fishing operation using a wastewater discharge facility which is a manufacturing facility for metal processed products, the maximum volume of waste per day of which is at least 0.1 cubic meters shall file a report with the competent authority.

Nevertheless, on April 19, 2012, the Defendant, at the same place of business, operated metal processing, etc. using two cNC lines and four cNC lines, which reuses water, oil, etc. without reporting to the competent authority, using two cNC lines and four cNC lines, which reuses in circulation (hereinafter referred to as "Automatic Line") (0.256 cubic meters in total) (0.256 cubic meters in total, each of 0.048 cubic meters x 0.04 cubic meters in 0.04 cubic meters x 4 x the maximum volume of daily wastewater generated 0.256 cubic meters).

2. Determination

A. The definitions of terms used in this Act under Article 2 (Definitions) of the related Acts and subordinate statutes and the Water Quality and Aquatic Ecosystem Conservation Act (hereinafter “Act”) are as follows:

4. The term “wastewater” means the water mixed with liquid or solid water-quality pollutants, which can not be used as it is for any purpose;

10. The term "wastewater discharge facilities" means facilities, machinery, apparatus, and other objects determined by Ordinance of the Ministry of Environment, which discharge water pollutants;

Provided, That ships and marine facilities under subparagraphs 16 and 17 of Article 2 of the Marine Environment Management Act shall be excluded.

(1) A person who intends to install emission facilities shall obtain permission from the Minister of Environment or make a report to the Minister of Environment under the conditions as prescribed by the Presidential Decree.

Those who intend to install wastewater non-discharge facilities pursuant to paragraph (7) shall obtain the permission of the Minister of Environment.

(1) A person who has obtained permission or permission for alteration, or has filed a report or a report on alteration under the provisions of Article 33 (1) through (3) (hereinafter referred to as "business operator") shall install the relevant emission facilities.
