Reasons
Punishment of the crime
1. No person who violates the Act on the Law of Houses and the Act on the Protection of Electronic Documents shall transfer or acquire an occupant's savings certificate or a housing association member's status, etc. in order to have a person acquire or have a house constructed and supplied pursuant to the Act of a house, and no person shall transfer or lend a certificate of official approval to any third person for the purpose
Nevertheless, the Defendant offered a false transfer using another person’s official certificate, etc. and offered by another person’s offer to sell the passbook, official certificate, etc. from a specialized speculation that resells the winning sales right to purchase apartment units, and transferred the subscription form, the passbook, and the official certificate as follows.
A. On March 1, 2014, the Defendant received a proposal from B to sell an offer form, a certified certificate, etc., and accepted the offer form, and sold the savings passbook (Account Number C) in the name of the Defendant, a resident savings certificate, and the USB, a certificate of seal impression, a resident registration abstract, etc., and received a delivery of KRW 5 million on March 19, 2014 in return.
B. On August 2015, the Defendant received a proposal from D to sell a passbook, a certified certificate, etc., and accepted it, and sold to D the passbook (Account Number G), and the USB, a certificate of personal seal, and a certified resident registration abstract, etc. in the front of the E apartment at the Seocho-si, Young-si, the Defendant sold to D the savings account of the Defendant, a resident’s name, the deposit account book (Account Number G), and issued KRW 300,000,000 on August 4, 2015.

On October 2016, the Defendant was offered to sell a passbook, an official certificate, etc. from D and consented thereto, and on October 1, 2016, the Defendant’s name, the occupant savings certificate, to D from I near Songpa-gu Seoul H Station.
