피고인은 거제시 C에 있는 D 앞 공영 주차장을 관리하던 중 그곳에 차량을 주차한 피해자 E( 여, 24세) 가 선불로 지급한 주차 비 일부를 돌려 달라고 요구하자 창문을 두드려 문을 연 피해자에게 " 씨 발년, 미친년 아 "라고 욕설을 하고 주먹을 쥐고 때릴 듯이 시늉을 하여 피해자를 협박하였다.
