A defendant shall be punished by imprisonment for two years.

Punishment of the crime

On July 31, 2009, the Defendant was sentenced to four years and ten months of imprisonment for the violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. at the Busan District Court, and the judgment became final and conclusive on October 15, 2009.

On January 18, 2008, the Defendant entered into a sales contract of KRW 155,207,000,000,000,000,000 for F forest land owned by the victim E at the Certified Judicial Scriveners Office in Ulsan-gu, Ulsan-gu, Seoul-do, with the victim E, and concluded a sales contract of KRW 400,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000 won for the said forest under the name of G is first established in relation to the right to collateral security, the Defendant was supplied with 0,000,000 won for the following means:

However, the facts are as follows: (a) the Defendant borrowed 100 million won from I to B, which was known to the police on January 29, 2008 immediately before the conclusion of the above contract, through H, in the name of H, which was a collateral for KRW 130 million to be used as the sales contract amount of the above forest; and (b) provided a collateral for KRW 130 million with the loan interest at KRW 130 million in the name of G as above; (c) if the Defendant is unable to repay the above loan interest by January 29, 2008, the Defendant promised to transfer the above loan interest to I by the maximum debt amount of KRW 600 million established in the name of G; (d) at the time of the judgment, the Defendant was liable for the victims of the above crime of fraud, etc., which became final and conclusive; and (e) at the time, the Defendant was unable to lend the loan from I due to the loan relationship with I, the principal and interest of KRW 3100 million,008.
