1. The Defendant’s KRW 37,920,738 and the Plaintiff’s annual rate from June 2, 2016 to November 16, 2017, and the following.
Reasons
1. Occurrence of liability for damages;
A. The Korea National Oil Corporation established the following facts: (a) from April 4, 2015 to April 20, 2015, the Korea National Oil Corporation established the East East Sea (attached Form B mining area included in the work site map and coordinates; hereinafter “the sea of this case”).
(2) The term “the instant exploration operations” in the aggregate of the above preparatory operations and exploration operations by using the petroleum exploration lines.
A) At that time, the Defendant: (a) carried out assistive activities, such as removal by cutting the ropes for marking fishing gear installed at the sea of the instant case, so that the exploration operations of the instant case can be carried out smoothly; (b) the Plaintiff installed the instant fishing gear, such as d (the current name was changed to E; hereinafter referred to as “D”); and (c) with the F’s line line line D, with a red-scale fishing operation; and (d) with a fishing gear installed at the sea of the instant case (hereinafter referred to as “18 side”; and (d) with a fishing gear installed at the sea of the instant case to carry out the instant fishing operation, such as 18 fishing gear; and (e) with a fishing gear installed at the sea of the instant case (hereinafter referred to as “18 fishing gear”); and (e) with a fishing gear installed at the sea of the instant case to carry out the fishing operation, such as high-speed fishing operation using F.
3) During the exploration work of this case, the Defendant removed the parts of 18 and 9 installed at the sea of this case. Accordingly, the Plaintiff lost the fishing gear of this case No. 18 and the fishing gear of fishing ground No. 9 (hereinafter “instant accident”).
(4) On April 12, 2015, the Plaintiff discovered the loss of fishing gear of a fishing ground No. 18, and received the damage from the G Fisheries Information and Communications Bureau on April 23, 2015. On April 9, 2015, the Plaintiff discovered the loss of fishing gear No. 9 and received the damage from the G Fisheries Information and Communications Bureau on April 20, 2015.
5. On the other hand, on March 18, 2015, the Korea National Oil Corporation is expected to carry out the exploration work of this case at the sea of this case, as it is planned to carry out the exploration work at the sea of this case.
