1. The plaintiff's claims against the defendants are all dismissed.

Basic Facts

When there is a problem that the "Naeter System", which is a tendering system of the public procurement agency under the jurisdiction of the Defendant Republic of Korea, should pay a large amount of royalties through the existing public tender system of the public procurement agency, and there is a problem that hacking risk is vulnerable to security, the Defendant Republic of Korea would promote a project to build a virtual bidding system based on the cloud of the open source (software satisfactory to anyone who can report and use the code without any special restriction) without any heating.

On March 2013, Defendant Republic of Korea (hereinafter “pre-technology review meeting”) conducted a meeting to verify the feasibility of the instant project, to examine the technology held by the participating companies, to examine the compatibility with the national core system, and to examine the feasibility of the instant project (hereinafter “pre-technical review meeting”), and the Plaintiff also participated in the pre-technical review meeting.

On May 29, 2013, Defendant Republic of Korea announced a public announcement for the instant project (hereinafter “instant public announcement”) (hereinafter “instant public announcement”).

The defendant Republic of Korea presented an example of the network formation of the virtual bidding system to refer to the participants in the tender proposal application attached to the instant tender announcement.

The Plaintiff entered into a business agreement with Eex Information Technology Co., Ltd. (hereinafter “Eex Information Technology”), and Eex Information Technology was provided with relevant technologies from the Plaintiff in accordance with the above business agreement, and participated in the instant bidding.

In addition, Defendant Tax Co., Ltd. (hereinafter “Tax Information Technology”), Egypt Co., Ltd. (hereinafter “Tax Information Technology”), Egypt Co., Ltd. and Handfypt Co., Ltd. participated in the bidding.

Defendant Republic of Korea shall evaluate bid proposals submitted by participants in bidding on June 18, 2013.
