Reasons
1. Basic facts
A. On October 30, 2013, the Plaintiff: (a) was engaged in music and music and music record production business; and (b) entered into a short-term bargaining agreement with C, a legal representative of the Defendant, and the Defendant with a view to forming a seven string group consisting of the Defendant, including the Defendant; and (c) the part related to the instant case is as follows.
(hereinafter referred to as “instant contract”). Article 3 (Obligation of A) (1) of the Act (hereinafter referred to as “the Plaintiff”) provides maximum efforts to enable B (Defendant) to receive tra bargaining and test in the optimal environment, and perform the arrangement of tra bargaining lines and the formation of traps to improve the quality of B, and the overall expenses incurred in the course of tra bargaining shall be borne first by A.
Article 4 (Obligations to Section B) (Obligations) In order to achieve the purpose of this Agreement, each of the following affairs shall be faithfully performed for A during the term of this Agreement, and if it is intended to perform the following affairs for the principal or for a third party, prior written consent of A shall be obtained:
(1) B must make to the maximum extent possible efforts to improve the performance of its duties, and must faithfully make such efforts as Party A’s designated trading lines and its test and contribution.
(3) B shall make contributions in accordance with the schedule, as directed by A, to the t bargaining and test-related contribution work planned by A or a third party as designated by A.
Article 5 (Cancellation or Termination of Contract) (1) Where A or B violates the terms of this Agreement, the other party may first request the offender to correct the violation by setting a grace period of 14 days, and where the offense is not corrected within that period, the other party may cancel or terminate the contract and claim damages.
