Reasons
Punishment of the crime
1. [2016 Highest 3372] Defendant A, while running a mobile phone opening business from agency F (representative G) of the mobile phone agency in Jung-gu Seoul Metropolitan Government, Defendant A stored the former identification card in a file. A
Defendant A, at F stores around October 14, 2015, had access to SK computer programs using a tables PC exclusive for opening a mobile phone without H’s consent for the purpose of opening a mobile phone in his/her name; had entered the name, date of birth, etc. in the space of customer information on the application for new subscription of the service; stated “H” with a smart fence in the space of customer information on the application for new subscription of the service; had forged H’s signature in order to use H’s signature at his/her own discretion on the next side; and had the file of the application for new subscription of the SK cell phone, which was so forged, sent the file of the application for new subscription of the service to the employee in charge of SK Telecom via the Internet.

A, from that time until December 24, 2015, the signature of each other was forged and used for the purpose of exercising the right to open the cell phone without permission through 49 times, as shown in attached Table 1, from that time to that time, respectively.
B. As if H consented to opening of the cell phone, Defendant A, at the same time, at the same place, and in the same manner, had forged H’s signature to the victim SK Telecom, and applied for opening of the cell phone as if H were to pay properly the mobile phone charges and mechanical fees opened in the name of H, and deceiving the victimized company, and then, Defendant A was issued one mobile phone unit from the victimized company with gallon ju City of 6,900 won at the market price opened in I on the same day.

A shall be issued from that time to December 24, 2015 a total of 49 mobile phones equivalent to the total market value of 51,251,470 won by the same method as attached Table 2, as shown in attached Table 2.
