1. The defendant,
A. In the case of Plaintiff A, 1, 151, 152, 153, 154, 50, 51, 51, 152, 153, 154, 50, 51, among 19,206 square meters of forest land D.
Reasons
1. Facts of recognition;
A. On April 20, 2015, Plaintiff A changed the area from 19,206 square meters of D forest land, E, 188 square meters of land, and F, 180 square meters of land to 180 square meters of land on April 20, 2015. Plaintiff B and C own each share of 1/2 of 4,975 square meters of G, and Plaintiff B and C own each share of 4,975 square meters of land before G.
B. On September 2013, the Defendant is carrying out construction of a new building, such as retail stores and offices, on the H 1,762 square meters and 4,380 square meters of I forest land (the land listed in the above shall be specified only by the lot number, both of the land listed in the above) located adjacent to the land owned by the Plaintiffs.
다. 피고는 위 건물 신축 공사를 하면서 원고들 소유의 토지 중 일부의 경계를 침범하여 석축 등을 쌓는 토목공사를 하고 있는데, 해당 침범 부분은 D 토지 중 별지 도면 표시 151, 152, 153, 154, 50, 51, 151의 각 점을 차례로 연결한 선내 (ㅁ) 부분 5㎡, 같은 도면 표시 154, 155, 156, 157, 49, 154의 각 점을 차례로 연결한 선내 (ㅂ) 부분 12㎡, E 토지 중 같은 도면 표시 139, 92, 165, 130, 131, 132, 173, 133, 134, 135, 136, 137, 138, 139의 각 점을 차례로 연결한 선내 (ㄴ1) 부분 12㎡, F 토지 중 같은 도면 표시 157, 158, 159, 160, 161, 162, 49, 157의 각 점을 차례로 연결한 선내 (ㅌ) 부분 17㎡ 및 G 토지 중 같은 도면 표시 150, 151, 51, 92, 139, 140, 141, 142, 143, 144, 145, 146, 147, 148, 149, 150의 각 점을 차례로 연결한 선내 (ㅎ) 부분 89㎡(이하 합하여 ‘경계 침범 부분’이라 한다)이다.
2. According to the facts of the above recognition, the defendant is obligated to remove facilities, such as stone embankments, etc., accumulated on the part over the boundary of the plaintiffs and deliver the above part of the land to the plaintiffs.
3. In conclusion, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
