Punishment of the crime

The Defendant is a person who is engaged in the operation of FLsty taxi.

On October 4, 2016, around 05:20 on October 4, 2016, the Defendant proceeded two lanes in front of H in Seocho-gu Seoul Metropolitan Government G at a speed of about 72 km per hour from the 3rd intersections to the intersection of the south side of the terminal.

At the time, since there are many people on the street, it is difficult for a driver of a motor vehicle to view it as a night, and there was a road with 60km speed at a restricted speed. In such a case, a person engaged in driving a motor vehicle has a duty of care to prevent accidents from being driven due to the reduction of speed, thorough examination of the front and right, accurate operation of steering devices, brakes and other devices, and failure to drive the motor vehicle at a speed or in a manner that may cause danger and harm to others according to the road traffic situation and the structure and performance of the motor vehicle.

Nevertheless, the defendant neglected the above duty of care and neglected the victim I (I, 76 years old) who walk the above road to the right side from the left side of the taxi driving direction, and was in front of the above taxi.

Accordingly, the defendant caused the victim's death due to the shock of the above accident in around 05:52 on the same day when he was sent back to the Gangnam-gu Seoul Metropolitan Government School of Generation and the Gangwon-nam Sym Hospital of University Gangnam-gu University.
