Reasons
Punishment of the crime
1. around September 5, 2018, Defendant B and Defendant C conspiredd to take out the foreign currency owned by Defendant B out of the Republic of Korea to take out the foreign currency abroad at a mutually influent restaurant located in the Sungwon-gu, Changwon-gu, Changwon-gu, Sung-gu, Sung-gu, Sung-gu.
Accordingly, at around 11:00 on the same day, Defendant C made a phone call to A, “The foreign currency would be KRW 400,000 at the expense of water, so the foreign currency would be carried out closely, and the request was made so that A would be carried out closely.”
At around 17:00 on the same day, the Defendants transferred A from F in the above E to the Kimhae International Airport for Ma, and issued to A an air ticket starting from 20:30 on the same day as US$10,000 and 300,000,000,000,000 owned by Defendant B (total, KRW 42,000,000,000).
Therefore, the Defendants did not report to the head of the competent customs office about 10,000 U.S. dollars and 300,000 U.S. dollars to A (the sum of KRW 42,00,000) and had them enter the airport as the airport departure site, but it did not lead to the wind that A does not depart from the Republic of Korea due to its change.
As a result, the Defendants conspired to induce A to export payment means without reporting to the head of the competent customs office, but failed to do so.
2. Defendant A
(a) Any person who violates the Foreign Exchange Transactions Act shall report to the head of the competent customs office any means of payment exceeding 10,000 U.S. dollars;
Nevertheless, at around 18:32 of the same day, the Defendant passed the departure inspection zone by concealing USD 10,000,000,000,000,000,000,000,000,000,000,000 from B according to the teachers of B and B (total, KRW 42,000,00,000,000,000), at the second airport of the Kimhae International Airport located in 108,00,00 Busan Gangseo-gu, Busan, for entry into the airport, and went away with the departure site in foreign currency while waiting for aircraft boarding.
