1. The part of the judgment of the first instance against R, U, V, AB, and AC is modified as follows.
The defendant is the plaintiff R, V, AB.
Reasons
1. Basic facts
A. On November 10, 2003, the Seoul Special Metropolitan City Mayor of the implementation of the AF Urban Development Project designated the Defendant as the implementer of the AF Urban Development Project (hereinafter “instant project”). On December 24, 2004, the Seoul Gangdong-gu Seoul Metropolitan Government approved the designation of an urban development zone and the development plan for AH Japan, approved the housing construction project plan on December 27, 2004, and approved the Defendant’s implementation plan for the urban development project on December 27, 2004.
From November 10, 2003 to December 31, 2009, the Defendant publicly announced a compensation plan for the instant project on October 8, 2004 and notified the landowner and related person of a compensation plan at that time, and the main contents thereof are as follows.
[Public Notice of Criteria for Relocation Measures for AF Urban Development Zones: Article 78 of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects and Article 40 of the Enforcement Decree of the same Act as the base date for relocation measures: July 9, 2003; Provided, That on April 9, 2003, a tenant is supplied to a person who owns a house on his/her own land prior to the base date and has resided in the house concerned as of the date of conclusion of the agreement or the date of expropriation of the agreement.
Provided, That a person who voluntarily takes the place after concluding a contract for consultation shall be supplied with not more than 85§³ of apartment units in the business area.
(2) Paragraph (1) shall apply mutatis mutandis to a person who has not owned and continuously resided in a house on his/her own land within the project zone from the base date to the date of public announcement of a compensation plan since before the base date of relocation measures.
(3) The project zone as of the date of public announcement of the indemnity plan for acquisition after the base date.
