Reasons
Punishment of the crime
[Criminal Justice] On January 10, 2017, the Defendant was sentenced to 2 months of imprisonment with prison labor for property damage and 4 months in the Changwon District Court, respectively, and completed the execution of the sentence in the Busan Correctional Institution on November 8, 2017. On November 15, 2018, the same court was sentenced to one year for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and completed the execution of the sentence in the Common Detention House on September 10, 2019.
【Criminal Facts】
1. On November 24, 2019, at around 12:50 on November 24, 2019, the Defendant: (a) found the Defendant in a state of drinking “D” shop operated by the Victim C; (b) took a mixed bath; (c) took dancing to the victim with a large amount of 20 minutes of the disturbance, such as “Chewing year, the same year, and her hair (b)”, and she took a bath to the victim; and (d) found the victim at the said Schlage on the same day at around 14:43 on the same day, the Defendant prevented the victim from entering Schlage by having 1 hour and 30 minutes of the disturbance, including “the same bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of bit of fluor of fluor of the entrance.
Accordingly, the Defendant, as such by force, found the victim’s temporary business from November 27, 2019 to November 37, 2019, as shown in the crime list, from that time, obstructed the victim’s temporary business by avoiding disturbance in a total of three times as above.
2. Definating;
가. 피고인은 2019. 11. 27. 11:25 제1항 기재 장소에서 피해자 E(여, 78세)가 “A씨, 술에 취한 것 같으니, 이제 집에 가서 좀 자지”라고 제지를 하자 슈퍼 업주인 C 등이 듣고 있는 자리에서 피해자에게 “야 이 씹할 년아, 뭘 쳐다 봐, 개같은 년아, 죽을래, 모가지 따버린다, 배를 쑤셔버릴라, 주디 닥쳐라!”라고 큰소리로 소리를 쳐 공연히 피해자를 모욕하였다.
B. On November 27, 2019, the Defendant reported to the police officer on November 27, 2019, that the Defendant interfered with Schlage business, as described in paragraph (1).
