1. As to the Defendant Aman Design Co., Ltd., the amounting to KRW 100,000,000 for the Plaintiff and the amount pertaining thereto from August 6, 2014 to January 15, 2015.

1. Basic facts

A. On May 19, 2014, the Plaintiff and Defendant Aman Design Co., Ltd. (hereinafter “Defendant Aman Design”) concluded a partnership and a job contract (hereinafter “instant contract”) with the following terms and conditions.

- 피고 아트석디자인은 원고에게 군포시 당정동 543 IT밸리 아파트형 공장, 인덕원 IT밸리 아파트형 공장, 수원 IT밸리 아파트형 공장의 입주업체로부터 수주한 인테리어 공사 전부와 KCC 홈시스로부터 수주한 인테리어 공사 중 협의된 부분 및 기타 업체로부터 수수한 인테리어 공사의 80%를 양도함 - 원고는 피고 아트석디자인에게 위 인테리어 공사에 대한 보증금으로 1억 원(이하 ‘이 사건 보증금’이라 한다)을 지급하고, 피고 아트석디자인은 위 인테리어 공사가 마무리 되는 시점에 원고에게 이 사건 보증금을 반환함 - 계약기간 : 2014. 5. 28.부터 상호 협의한 날까지 - 피고 아트석디자인은 인테리어 공사의 영업을 담당하고, 원고는 공사를 담당함 - 원고는 피고 아트석디자인에게 양도받은 인테리어 공사 중 아파트형 공장은 공사금액의 3%를 지급하고 KCC 홈시스 및 마진에 30%를 배분하� 것을 기준으로 하되 협의를 통해 정함

7. Until 14.1, up to 10.15 million won of the instant deposit was paid, and promotional materials of the IT ballast were manufactured and supplied in lieu of the payment of the remainder of five million won.

C. In the event that the Plaintiff and the Defendant Tyan Design failed to make orders for the interior works anticipated at the time of the conclusion of the instant contract, the instant contract was terminated on July 24, 2014, and the instant deposit was returned, and the time of the repayment of the deposit was agreed to make mediation around July 29, 2014 (hereinafter “instant termination agreement”).

After that, the repayment schedule of the deposit of this case is applicable.
