A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

Social service personnel shall not desert from their service for at least eight days in total without justifiable grounds.

Nevertheless, the Defendant, who was called on November 26, 2015 and served as social service personnel belonging to the East Yacheon Fire Station located in the 6th century in Gyeonggi-do, Gyeonggi-do, 2015, left from office on September 22, 2017, and thereafter left office on March 20, 2018 without justifiable grounds, from that time, the Defendant left office for at least eight (8) days in total, as written in the list of crimes in attached Form.

1. Application of Acts and subordinate statutes, such as a written investigation of renunciation of service and a written reason for renunciation of service;

On September 8, 2017, the Defendant, prior to the reason for sentencing under Article 89-2 subparag. 1 of the pertinent Act on criminal facts, retired from service several times and was sentenced to a suspended sentence of six months for a violation of the Military Service Act on September 8, 2017 and became final and conclusive on September 16, 2017.

Nevertheless, from September 22, 2017 to September 22, 2017, two weeks after the date of the above ruling, there is a high possibility of criticism.

However, if there is a child who shall support the defendant, and if the detention of the defendant seems to cause difficulty to the dependent, it shall be considered in favor of the defendant.

In full view of the motive and background of the crime including the above circumstances, the method and consequence of the crime, the circumstances after the crime, the age, environment, and criminal records, the punishment as ordered shall be determined.
