A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Around October 2, 2018, the Defendant: (a) around October 2, 2018, the victim B, who returned to the Busan Seopo-dong, Busan Seopo-dong for more than 30 years, had a factory and office in the process of delivering the goods to the Ministry of National Defense; (b) as if there were corporations abroad, the victim had re-influence as if there were corporations abroad; and (c) around 13:00 on October 26, 2018, when the victim had re-influenceddddd the victim’s refund to the Ministry of National Defense; and (d) on October 26, 2018, the victim was prevented from transferring the corporation from Seoul to Busan, by means of tax evasion investigation. There was a so-called “the head of the Tong to the National Tax Service.” (c) KRW 8.200,000,000,000,000 won capital increase after the head of the Tong to the present.”
However, in fact, the defendant did not carry out the business of delivering goods to the Ministry of National Defense, and even if he did not receive money from the victim without any specific occupation, he did not intend to use it as personal debt repayment and cost of living, so he did not have any intention or ability to pay it.
As such, the Defendant, by deceiving the victim, received 15 million won from the victim to the C (D) account in the name of the Defendant on the same day as the loan money, from the time to November 9, 2018, and took over 24 million won in total on three occasions, such as the statement in the list of crimes, from November 9, 2018.
2. On November 20, 2018, the Defendant made a false statement to the effect that “The victim’s G hotel operated by the victim E located in Busan, Jin-gu, Busan, would pay accommodation expenses to the victim “I will pay the victim a house off.”
However, in fact, the defendant was in the state of continuing contact with his wife at the time, and there was no particular monthly income, and accommodation charges are in the water.
