A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The Defendant intended to borrow Seongbuk-gu Seoul apartment C (hereinafter “the instant real estate”) as a collateral and repay the Defendant’s personal debt. However, the Defendant’s right to request the transfer of ownership based on the Defendant’s pre-sale promise was established on the instant real estate. However, without the consent of the victim, the Defendant arbitrarily forged the relevant documents without the consent of the victim, and arbitrarily deleted the provisional registration, and then received the instant real estate as a collateral.

1. Larceny;

(a) The Defendant shall take the driver’s license of the victim in the house of the victim of Seongbuk-gu Seoul apartment E apartment F, Seongbuk-gu, Seoul, in May 2017, and the victim shall take the driver’s license of the victim out of the wall cresh in the victim’s room using the cresh of the victim’s house;

B. The Defendant, at around 11:00 on May 21, 2017, at the same place as the above A. at the same time, taken out a provisional registration certificate of the instant real estate owned by the victim in a creb of the victim’s house, using the creb of the victim’s house at the same place.

2. On May 26, 2017, at the I Office located in Seongbuk-gu Seoul building H on May 26, 2017, the Defendant: (a) stated that D’s right to request the transfer of ownership was delegated by D to D for cancellation of the registration; (b) made D’s employees J, who are aware of such fact, prepare a proxy of D’s name that the right to request the transfer of ownership of the instant real estate is delegated to the Defendant with all actions regarding cancellation of the registration; and (c) affixed a seal impression that the Defendant brought about from D’s home to D’s name.

Accordingly, for the purpose of uttering, the Defendant forged a letter of delegation in the name of D, a private document related to rights and obligations.

3. The Defendant, at around 13:00 on May 29, 2017, submitted the forged power of attorney to the Dongdaemun-gu registry office located in Dongdaemun-gu Seoul, Dongdaemun-gu, Dongdaemun-gu, Seoul, as if it were genuine.
