1. The Plaintiff:
A. Defendant A: 61,454,545 won;
(b) to the extent of the property inherited from the net F, Defendant.
Reasons
1. Basic facts
A. On January 22, 2010, Hyundai Swiss Mutual Savings Bank (hereinafter referred to as the “Innex 2”), on the same day, on January 22, 2010, Hyundai Swiss Mutual Savings Bank (hereinafter referred to as the “Innex 200 million won”) set the Defendant A’s debt amounting to KRW 260 million on January 22, 201 as the expiration date of the credit term; the interest rate is 11% per annum; the overdue interest rate is determined according to the terms and conditions of the credit transaction of the mutual savings bank; and the PlaintiffF (hereinafter referred to as the “the network”) set the Defendant A’s debt amounting to KRW 338 billion as the collateral guarantee amount.
B. On March 30, 2011, Nonparty Bank transferred the instant claim to the Plaintiff, and notified Defendant A and the Deceased thereof.
C. As of September 25, 2014, the principal and interest of the instant claim are KRW 444,217,545 in total (i.e., principal interest of KRW 222,417,350, such as interest in arrears of KRW 221,80,195).
On the other hand, Defendant A received the Daejeon District Court 2012Hadan2019, which was decided bankrupt on November 9, 2012, and was granted a decision of immunity on March 27, 2013 as 2012Ha2, 2019.
E. The Deceased died on June 13, 2013, and the Defendant B’s wife, Defendant A, C, D, and E are children of the Deceased.
F. On March 25, 2015, Defendant D filed a report on the re-approval of inheritance with the Busan Family Court 2015-Ma454 on March 25, 2015, and received a judgment to accept it on March 25, 2015. Defendant C filed a report on the re-approval of inheritance with the Busan Family Court 2015-Ma520 on February 9, 2015, and received a judgment to accept it on April 6, 2015. Defendant E filed a report on the re-approval of inheritance with the Busan Family Court 2015-Ma720 on March 2, 2015, and received a judgment to accept it on August 12, 2015; Defendant B and A filed a report on the re-approval of inheritance with the Busan Family Court 2015-Ma6777 on February 26, 2015, and thus, Defendant C rejected the above reporting period on the re-approval of inheritance.
