A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

The Defendant, as the owner of D in Jeju City, concluded a contract on June 1, 2012 to treat livestock excreta generated at the time of raising pigs, on the condition that he/she will receive rent of KRW 50 million per annum from around June 1, 2012 to May 31, 2021, and KRW 80 million per annum for the treatment of excreta, and that livestock excreta generated at the time of raising pigs will be treated by the Defendant.

On the other hand, the above D was exposed twice due to the illegal discharge of livestock excreta, and was revoked on July 20, 2015 from Jeju viewing. The revocation lawsuit against the above disposition is also dismissed on November 11, 2015, and the permission for installation of livestock excreta discharge facilities is revoked.

1. No person who has not obtained permission for the installation of an illegal discharge facility of livestock excreta into public waters shall discharge or discharge livestock excreta into public waters by discharging or neglecting it;

Nevertheless, on April 29, 2016, the Defendant neglected to take any measure despite the fact that, around April 29, 2016, the Defendant, by linking approximately 32 tons of the discharged excreta to the storage of livestock excreta with rubber 80m in length, in a state that is not converted into the F forest in Jeju City, a grassland for which a report on the spraying of liquid manure was made, the Defendant left approximately 10 tons of the discharged excreta into the excellent pipes installed on the G road in Jeju, which is a public waters.

2. A person who fails to obtain permission to install a waste-generating facility without permission shall not discharge livestock excreta flowing into a disposal facility without converting it into resources or without discharging livestock excreta without discharging it through the final outlet;

Nevertheless, on June 3, 2016, the Defendant installed three places of livestock excreta storage tanks connected to 40 to 50m rubber Group in diameter on Jeju-si, a grassland for which no report on spraying liquid manure was made, and discharges approximately 160 tons of high-toxic livestock excreta generated in H and I, a grassland for which a report on spraying liquid manure was not filed, and which were not converted into resources.
