1. The lawsuits of plaintiffs B, C, E, F, and G shall be dismissed.
2. The Defendant’s expulsion resolution against Plaintiff A and D, respectively, on July 15, 2014.
Reasons
1. Basic facts
A. The Defendant is a fishing village fraternity under the JAF (hereinafter “JA”) established under the Fisheries Cooperatives Act with the area of the IF as the area of the three-party fishing village fraternity.
B. On July 9, 2014, the Defendant sent a notice of convening an extraordinary general meeting to the members, including the Plaintiffs, to the effect that “the general meeting with the expulsion of the Plaintiffs as an agenda item, shall be held on July 15, 2014, and shall have the opportunity to make a statement at the extraordinary general meeting.” On July 15, 2014, 33 persons, including the Plaintiffs, present at the extraordinary general meeting held on July 15, 2014, and passed a resolution of expulsion against the Plaintiffs with the consent of all 26 persons, other than the Plaintiffs.
(2) If the members of a fishing village fraternity were to be notified of the violation of the regulations of the members of the fishing village fraternity, and the members of the fishing village fraternity do not have any disadvantage in the investigation process of fishery damage, the report on the violation of the regulations of the members of the fishing village fraternity is not proper. (3) If the members of the fishing village fraternity were to be informed of the violation of the regulations of the members of the fishing village fraternity, and the members of the fishing village fraternity were to be disadvantaged, the minutes of the general meeting of the contents of the fishing village fraternity shall be prepared in the manner that the members of the fishing village fraternity are the head of the fishing village fraternity. (2) If the members of the fishing village fraternity were to be informed of the violation of the regulations of the members of the fishing village fraternity, the members of the fishing village fraternity shall not be subject to any disadvantage. (3) If the members of the fishing village fraternity were to approve the extension of the period of the fishery area licensed within the fishing village fraternity, the members of the fishing village fraternity are the head of the fishing village fraternity without the consent of the members.
