A defendant shall be punished by imprisonment for not less than three months.

An application filed by an applicant for compensation shall be dismissed.

Criminal facts

On March 27, 2014, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Seoul Eastern District Court, and on May 13, 2015, the execution of the sentence was terminated in the Daejeon Prison.

『2015고단2093』 피고인은 2015. 7. 4. 13:30경 광명시 C에 있는 피해자 D이 운영하는 중구집에서 피해자에게 대금을 지급할 듯한 태도를 취하며 소주 1병과 짬뽕 1그릇을 주문하였으나 사실 피고인은 그 대금을 지급할 의사나 능력이 없었다.

피고인은 이와 같이 피해자를 기망하고 이에 속은 피해자로부터 시가 8,000원 상당의 짬뽕 1그릇, 소주 1병을 교부받았다.

Around 20:00 on July 1, 2015, the Defendant: (a) was able to pay food costs in G restaurants operated by the Victim F in Ansan-si E, Ansan-si; (b) was able to do so as if the Defendant had no intent or ability to pay food costs; and (c) ordered 1 knife and 1 knife of the knife and 1 knife.

On July 14, 2015, the Defendant damaged the entrance to cover KRW 150,000 of the repair cost by putting the entrance door door back one time by walking off and walking off by hand, without any justifiable reason, at around 21:50 on a light-wise Haak-si operated by “K” operated by the victim B, a light-wise Haak-si.
