1. Basic facts

A. On July 29, 2017, D entered into a lease agreement (hereinafter “instant lease agreement”) with regard to G units (hereinafter “instant stores”) on the first floor of the ground in the 1st floor of the building located in E and Sung-nam-si, Incheon-si, with a view to the brokerage of Defendant B, with a view to KRW 40 million, monthly rent of KRW 150,000,000,000,000, monthly rent of KRW 1550,000,000, and the lease period of KRW 36 months from August 7, 2017 to August 6, 2020.

B. On August 4, 2017, the Plaintiff decided to establish a “H store” in the E and the instant store (hereinafter “instant cream bank”) and concluded an “IPC franchise agreement” in relation to its operation.

In the event that Defendant C Association (hereinafter “Defendant Association”) and Defendant B caused property damage to the parties to a transaction by intention or negligence in the course of real estate brokerage, Defendant B entered into a mutual aid agreement under which the Defendant Association shall pay mutual aid money within the limit of KRW 100 million for the damage (hereinafter “instant mutual aid agreement”). On the other hand, prior to the conclusion of the instant lease agreement, the building to which the instant store belongs pursuant to the Ordinance of Sungnam-si was unable to open a billiard room, scream room, singing practice room, and scke bar, etc. designated as a restricted business type.
