Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. In using and managing the means of access, no person who violates the Electronic Financial Transactions Act shall do any act of lending any third person while receiving, demanding or promising any compensation, unless otherwise specifically provided for in any other Act;

Nevertheless, on September 11, 2017, the Defendant received a proposal from a person who has no name, and consented to the proposal that “I will give KRW 1,500,000 per month if I want to lend the passbook,” and then delivered one passbook and a password connected with the Defendant’s name B bank account (C) at the Changwon bus terminal located in 371 as the original window of Changwon-si, Changwon-si.

Accordingly, the Defendant promised to provide compensation and lent the means of access.

2. No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall engage in gambling by using an act of providing property or financial benefits (hereinafter referred to as "similar act") to persons who win at the betting results by issuing sports betting tickets or similar things.

Nevertheless, at around 13:40 on July 15, 2017, the Defendant visited D, “E,” a website of the Internet private sports, using the ID, and transferred KRW 1,000,000 to G bank accounts (H) in the name of “F of a limited liability company,” designated by the operator of the said site, from B Bank Account (C) in the name of the Defendant, and used money by means of sending KRW 231,200,000 in total over 36 times as indicated in the attached Table [crime] to the account designated by the operator of the said website, and receiving cyber money corresponding to the money transferred as such, and displaying the money in Korea and abroad, such as camping and axis games, and receiving dividends in accordance with the plaque and receiving dividends, from that time, from October 14, 2017.
