1. The Defendant and the victim B (the age of 37) of the instant facts charged are marital relations.

around 07:40 on October 8, 2019, the Defendant told the victim to gather at the house of the Defendant in Seo-gu, Seo-gu, Seo-gu, Gwangju, Gwangju, but committed assault against the victim by plucking and plucking up the victim's hand and plucking his head with the left hand.

2. The instant case is an offense falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act.
