A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

피고인은 2016. 5. 5. 22:00 경 경기 광명시 B에 있는 'C' 앞에서 상의를 벗고 신발을 벗고 앉아 있던 중 “ 어떤 남자가 팬티만 입고 앉아 있다” 는 112 신고를 받고 그곳에 출동한 경기 광명 경찰서 D 지구대 소속 순 52호 순찰차를 향해 "야 이, 개새끼들 아 꺼져, 씨 발 놈들 니들이 나한테 해 준 게 뭐 있어 "라고 소리치며 옆에 놓여 있던 고무 슬리퍼와 피고인의 운동화를 집어 던지고, 순찰차에서 하차 한 위 지구대 소속 경찰 관인 경위 E을 향해 나머지 신발 한 짝을 집어던지고 위 경위 E의 멱살을 잡으려 하고, 이에 순경 F이 피고인을 공무집행 방해죄의 현행 범인으로 체포하려 하자 위 순경 F의 허벅지와 배를 발로 3회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers on handling 112 reports.
