1. The defendant A shall be punished by imprisonment with prison labor for ten months.

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant A, “2016 Highest 4476,” is the representative director of E, a corporation operating a facility construction business for children’s play, and Defendant B, a person who served from March 12, 2014 to November 17, 2015 as a bidder of the above E.

On July 2014, the Defendants conspired to make the Defendants determined as the successful bidder of the said construction by forging-si’s representative meeting, even though the Defendants independently bid for the replacement of children’s play facilities by the said E, G Co., Ltd. and H, a competitor company, to pretend as if they were participating in the said construction project, and submitting the following documents to the said apartment management office, thereby making the Defendants be determined as the successful bidder of the said construction project:

1. Forging a private document;

A. On July 2014, Defendant B, at the above E office located under the foregoing building 201 in the middle of the 2014 Kimhae-si, Kim Jong-si, the following: (a) stated the bidder: J; (b) the bid price in the tender form by using the computer; and (c) stated the supplier: (a) the supplier: (b) the supplier; (c) the aggregate amount: KRW 61,586,00,00 in the written estimate; and (d) written one copy of the name of G tender and the written estimate by affixing the corporate seal impression of the said G in the name of the above representative.

As a result, the Defendants conspired to act for the purpose of exercising their rights and duties, each of the above G G names, tenders, and estimates, which are private documents related to rights and duties.

B. Defendant B committed the crime of forging documents in the name of H, Inc., on July 2014, stated “B” in the tender form using a computer in accordance with the aforementioned offer at the office of the above E, which included “B”, “H, representative: K, and “The bid price: :00,000 won” in the quotation form, and indicated “B”, “B” and “57,740,000 won in total” in the quotation form, and affixed the seal impression of the said H’s corporation on the name of the above representative.
