All appeals filed by the prosecutor against the Defendants are dismissed.

1. Even though a person is delegated with the authority to prepare a document by the name of the document, the crime of forging documents is established if the document was prepared in the first month of the delegated authority.

The number of buyers of the land for livelihood countermeasures related to H business delegated the Defendants the authority to prepare documents necessary for the change of name from the right-holders to the right-holders in joining the G Association.

However, it cannot be deemed that the authority to determine the method of business promotion related to the new construction and sale of commercial buildings has been delegated.

The first month of the scope delegated by the Defendants determined to promote the new construction of commercial buildings and the sale of commercial buildings by the joint business place without going through legitimate procedures, such as the general meeting of the partnership, and the preparation of each joint business place contract, each special general meeting minutes, etc. stated in the facts charged necessary therefor

2. Summary of the facts charged in this case and the judgment of the court below

A. Summary of the facts charged in the instant case 1) The Defendants are H business (hereinafter “instant business”).

3) The main purpose of the Act is to build and sell a commercial building in the relevant living countermeasure site, and the preferential right to sell the living countermeasure site (e.g., the name “B-B-B-B-B-B-B-B-B-

(B) the right of preferential sale of the land for livelihood countermeasures (hereinafter referred to as the “right of preferential sale”) from the original residents and their original residents in the H district in which they acquired such right.
