1. The Defendant (Counterclaim Plaintiff) paid KRW 29,341,601 to the Plaintiff (Counterclaim Defendant) and its related amount from June 1, 2016 to December 15, 2017.
Reasons
1. Basic facts
A. On May 199, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with the Defendant to lease three floors (hereinafter “instant church”) from among the buildings listed in the attached list owned by the Defendant (hereinafter “instant building”) and used it as a religious facility. On December 3, 2013, the Plaintiff entered into a lease agreement with the Defendant for the lease deposit amount of KRW 80 million, monthly rent of KRW 550,000,000, and from December 3, 2013 to December 2, 2015, and the Plaintiff continued to use the instant church after the termination of the said lease agreement.
B. On December 29, 2015, a fire occurred on or around 23:30 of the instant building (hereinafter “instant fire”). The fire cause and the ground for expansion of burning stated in the fire site investigation report are as follows.
A summary of fire cause - Fire that is emitted from and burned out of a room used for residential purpose, which is located inside a church, and is presumed to have been burned around the room, and then burned around the computer, by viewing the inner burning trace as an inner burning trace, and considering that the electrical spreading traces is distinguished from the surrounding ship, it is presumed that the combustible materials of dust, such as clothes, etc., generated from the unexpected factors are emitted. The ground for expansion of burning is presumed to have been rapidly expanded due to the influence of a group of dust, such as clothes, etc., adjacent to the vessels that are connected to the vessels that are disturbed at the point of combustion.
